These Terms are meant to be clear, fair, and practical about what you can expect from TasteBud and what we expect from users.

1. Acceptance of Terms

These Terms and Conditions ('Terms') govern your use of TasteBud, including heytastebud.com, related web pages, APIs, and features (collectively, the 'Service').

By creating an account or using the Service, you agree to these Terms and our Privacy Policy.

2. Eligibility and Account Responsibilities

You must be legally able to enter into a binding agreement to use the Service. You are responsible for keeping your login credentials secure and for activity that occurs under your account.

  • Provide accurate account information and keep it reasonably current.
  • Do not share your account in ways that violate these Terms.
  • Notify us promptly if you believe your account has been compromised.

3. What TasteBud Provides

TasteBud provides AI-assisted food and drink discovery, place recommendations, and menu suggestions based on your requests, preferences, and available data sources.

Some features depend on third-party services (including Google and Stripe) and may vary by region, data availability, or provider constraints.

4. Recommendation and Safety Disclaimer

TasteBud recommendations are informational only. Restaurant details can change quickly, and AI-generated text may be incomplete or imperfect.

  • Always verify allergens, ingredients, cross-contact risk, hours, availability, and pricing directly with the business.
  • TasteBud is not a medical, nutritional, or professional advisory service.
  • You are responsible for decisions made using recommendations from the Service.

5. Free and Premium Features

TasteBud may offer free and paid tiers with different feature availability, including search limits, history windows, and preference controls.

Feature sets, usage limits, and eligibility rules may change over time as we improve the Service.

6. Billing, Subscriptions, and Tips

Paid features are processed through Stripe. By starting a paid subscription or tip payment, you authorize the applicable charges and any recurring charges for subscription plans.

  • Subscriptions may renew automatically based on the plan interval you select until canceled.
  • You can manage billing details and payment methods through Stripe billing flows provided in the Service.
  • If you cancel, access generally continues through the end of the current billing period unless otherwise stated.
  • Tip payments are voluntary one-time payments.
  • Except where required by law, fees and tips are non-refundable once charged.
  • Taxes may apply depending on your location.

7. Acceptable Use

You agree to use TasteBud lawfully and respectfully. You may not misuse or interfere with the Service.

  • Do not attempt unauthorized access to accounts, data, systems, or APIs.
  • Do not disrupt service integrity, performance, or security.
  • Do not use the Service to violate law, infringe rights, or distribute harmful content.
  • Do not scrape, copy, or reproduce proprietary parts of the Service except as allowed by law or written permission.

8. Third-Party Services and Content

The Service integrates with third-party services, including Google and Stripe. Your use of those services is subject to their terms and privacy practices.

We are not responsible for third-party websites, menu pages, ordering platforms, or external content linked or referenced through the Service.

9. Intellectual Property

TasteBud and its software, brand assets, interface design, and underlying technology are owned by TasteBud or its licensors and protected by applicable intellectual property laws.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial use.

10. Your Content and Feedback

You retain rights in the prompts and content you submit. You grant TasteBud a limited license to process that content as needed to operate, secure, and improve the Service.

If you provide feedback or suggestions, we may use them without restriction or compensation.

11. Availability, Changes, and Termination

We may modify, suspend, or discontinue features at any time. We may also suspend or terminate access for behavior that violates these Terms, creates risk, or harms users or the Service.

You may stop using the Service at any time. Certain provisions of these Terms remain in effect after termination (for example billing obligations, disclaimers, and limitations of liability).

12. Warranty Disclaimer

The Service is provided 'as is' and 'as available' without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, or accuracy.

13. Limitation of Liability

To the maximum extent permitted by law, TasteBud and its affiliates, officers, employees, and partners will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, goodwill, or business opportunities.

To the maximum extent permitted by law, our total liability for claims related to the Service will not exceed the greater of (a) amounts you paid to TasteBud in the 12 months before the claim, or (b) USD $100.

14. Indemnification

You agree to indemnify and hold harmless TasteBud and its affiliates from claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your misuse of the Service, violation of these Terms, or violation of applicable law.

15. Governing Law and Disputes

These Terms are governed by applicable U.S. law and the laws of the State of Texas, without regard to conflict-of-law principles. To the extent permitted by law, disputes will be resolved exclusively in state or federal courts located in Travis County, Texas.

16. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the 'Last updated' date and may provide additional notice through the Service.
